Terms & Conditions of the Wi-Fi Network Service

Federazione Italiana Tennis, with registered office in (00135) Rome, Stadio Olimpico, Curva Nord, Ingresso 44 (hereinafter referred to as “FIT”) holds, exclusively, the sports and commercial exploitation rights of the sports event called “Internazionali BNL d’Italia” (hereinafter referred to as the “Event”) currently taking place once a year in Rome at the sports venue of Foro Italico (hereinafter referred to as the “Venue”), which includes two tournaments intended for male players and female players, respectively. The Event is scheduled to take place in 2018, from 12 May until 20 May. In the days preceding the Event, specifically between 5 May and 10 May 2018, the so-called Pre-qualification Tournament of the Internazionali BNL Italia (hereinafter referred to as the “Pre-qualifications”, the winners of which can take part to the qualification phases of the tournaments of the Event) will also take place with a functional autonomy.
These General Conditions govern the Wireless Fidelity (“Wi-Fi”) access to the Internet, through “#ibi18 free wifi” network, by the public attending the Pre-qualifications and the Event (the “Service”).

1. Description and Features of the Service

1.1 The Service shall allow the party attending the Pre-qualifications and the Event at the Venue (the “User”) to access the Internet network via Wi-Fi through services provided by network operators, freely and without any charge and/or installation costs (without prejudice to article 1.2), exclusively in the Venue areas specifically identified and exclusively in the days between 7 May and 20 May 2018.

1.2 The User can use the Service through their own compatible mobile devices (e.g. PC, smartphones, handheld devices, etc.), appropriately configured and equipped with a network interface card Wi-Fi branded (able to communicate according to the 802.11a/b/g/n/h standard).

The User shall provide, at its own care and expense, for the necessary technical equipment needed to access the Service. Moreover, the User shall also bear the costs incurred for connecting to the Service, where applicable.

1.3 The Service is provided through shared band frequencies and without protection against interferences.

FIT shall not offer the User any guarantees and hereby declines all liability with regard to the quality of the Service, in particular to the quality of the network connection. The Service shall be provided through a free network, not protected against Internet traffic encryption; therefore, the use thereof is not recommended for the transmission of confidential data.

1.4 FIT reserves the right to suspend or interrupt the Service at any time and without prior notice. In the event of suspension or interruption of the Service, FIT shall not be liable for any damage, direct or indirect, caused to the User or to third parties (including losses and costs incurred as a result of suspension and interruption) as well as to the handheld devices used for the access to the “#ibi18 free wifi” network.

1.5 The User acknowledges and accepts that the “#ibi18 free wifi” network traffic may be subject to monitoring by FIT to ensure the correct use of the Service and the maintenance of the “#ibi18 free wifi” network performances at an adequate level. 

2 Activation of the Service

2.1 The access to the Service shall be reserved to the User who has provided his/her personal data and has expressed his/her intention to use the Service by completing the registration through his/her own handheld device.

2.2. Once the registration has been completed, the User shall accept the present “Terms and Conditions of the Service” and shall agree with the processing of his/her personal data pursuant to the Legislative Decree No. 196/2003 and subsequent modifications.

2.3. FIT reserves the right to unilaterally supplement and/or amend, at any time and without prior notice, these “Terms and Conditions of the Service”. Any amendments and/or supplements to these “Terms and Conditions of the Service” will be communicated to the User by publishing them on the homepage of the Service. After the communication that these “Terms and Conditions of the Service” have been amended/supplemented, the User that continues using the Service shall be deemed to have accepted the new conditions.

3. Obligations of the User

3.1. In using the Service, FIT encourages the Users to observe the “good manners” standards on the Internet network, known as “Netiquette”, as described by the “RFC 1855” document available at https://tools.ietf.org/html/rfc1855.

3.2. The Service is intended exclusively for the User’s personal use.

3.3. Using the Service, the User: i) shall not use the network in a manner intended to hinder or prevent other Users from accessing the Service; ii) shall not use the Service for communications intended to cause damages to other parties; iii) shall use the Service in accordance with the copyright and other intellectual and industrial property laws; iv) shall use the Service by complying with these “Terms and Conditions of the Service” as well as with the applicable laws.

3.4. Furthermore, whenever using the service the User:

  • shall equip his/her own handheld device with adequate protection against viruses or other forms of intrusion intended to cause damages to the “#ibi18 free wifi” network or to third parties;
  • shall not forward advertising and/or promotional messages or spam communications or bulk commercial messages to third parties, without such forwarding having been explicitly requested by the recipient or, however, without having been requested and obtained his consent;
  • shall not use equipment that may affect the “#ibi18 free wifi” network performances or that may infringe the right to privacy of the other Users of the Service.
  • shall not send materials and/or messages that encourage third parties to act unlawfully;
  • shall not feed into the Internet information which forms or contents may be pornographic, obscene, profane, racial, defamatory, offensive or incite violence;
  • shall observe any further rules or operational indications prescribed by FIT.

3.5. FIT may terminate the agreement without prior notice, thus interrupting the Service, in the event the User is in breach of these “Terms and Conditions of the Service”.

4. Liabilities of the User

The User shall be solely liable for any breach of these “Terms and Conditions of the Service”.

The User undertakes to indemnify and hold FIT harmless of any claim made, for any reason, by third parties in relation to the User’s use of the Service.

5. Processing of Personal Data

5.1. Pursuant to and for the purposes of Article 13 of the Legislative Decree No. 196/03 and subsequent modifications, FIT shall act as Data Controller of the data provided by the User in order to use the Service. Pursuant to Article 29 of the Legislative Decree No. 196/03 and subsequent modifications, FIT is assisted by Data Processors, the list of which can be known by sending a request by e-mail to the address digital@federtennis.it

Pursuant to and for the purposes of Article 32 of the Legislative Decree No. 196/03 and subsequent modifications, FIT hereby informs the User that his/her personal data will only be accessible by authorized persons and shall be processed, by means of computer and telematic instruments intended to ensure the maximum security and confidentiality, for the exclusive purpose to provide the Service.

5.2. The User may exercise his/her rights pursuant to article 7 of the Legislative Decree No. 196/03 by serving a registered letter with acknowledgement of receipt at: Federazione Italiana Tennis, Stadio Olimpico, Curva Nord, Ingresso 44 – (00135) Roma.
