The Italian Tennis and Padel Federation (the “FITP“) wishes to inform you that, in accordance with Article 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of individuals with regard to the processing of personal data (the “Regulation“), it needs to proceed with the processing of your personal data, collected automatically or provided by you through browsing or using the website https://www.internazionalibnlditalia.com (the “Website“).

This Privacy Policy, therefore, refers only to the Web Site and does not cover other sites or online services that can be reached through hyperlinks that may be published within it.

1. DATA CONTROLLER AND DATA PROTECTION OFFICER

The Data Controller is FITP, based in (00135) Rome, Stadio Olimpico – Curva Nord – Ingresso 44 Scala G (the “Data Controller”). The Data Protection Officer can be reached at privacy@fitp.it or via PEC at dpo@pec.federtennis.it.

2. TYPES OF DATA PROCESSED

To enable you to take advantage of the Website and its services – including the possibility of accessing your reserved area, subscribing to our newsletter and purchasing a Gift Card (i.e. a voucher of a predetermined value associated with a code, which allows the purchase of tickets through the Website) as well as to purchase tickets valid to attend the sporting event “Internazionali BNL d’Italia” or, where possible, request a refund of the price – the Data Controller needs to know and process some of your personal data, namely your first name, your last name, your date of birth and your email address. In addition, in order to ascertain the existence of the indispensable requirements for you to be able to take advantage of certain services (such as the access services to the sports event “Internazionali BNL d’Italia” provided for the disabled), certain data belonging to special categories, such as data relating to your state of health, may be required. Finally, in the event that, once you have made the purchase of a Gift Card or ticket, you would like to request the issuance of an invoice or, where possible, a refund of the price, in addition to the personal data already entered for registration and purchase, we will also ask you for the following data: your social security number, your residential address, your telephone number and your bank and/or postal account details.

Navigation Data

The computer systems and software procedures used to operate the Web Site acquire, in the course of their normal operation, some personal data whose transmission is implicit in the use of Internet communication protocols.

This category of data includes the IP addresses or domain names of the computers used by users who connect to the Web Site, the URI (Uniform Resource Identifier) notation addresses of the requested resources, the time of the request, the method used in submitting the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (successful, error, etc.) and other parameters relating to the user’s operating system and computer environment.

These data, necessary for the use of the Website, are processed for the sole purpose of obtaining statistical information on the use of the services (most visited pages, number of visitors per time slot or daily, geographical areas of origin, etc.) and to check the proper functioning of the services offered.
Browsing data do not persist for more than seven days and are deleted immediately after their aggregation, without prejudice to the possible need to ascertain crimes by the judicial authorities.

Data provided voluntarily by the user

The creation of your reserved area, the subscription to our newsletter and the purchase of Gift Cards and/or tickets through the Website, entail the acquisition of your first name, your last name, your date of birth, your email address, and, in the case of the purchase of Gift Cards or tickets, the data listed in paragraph 2 above. In addition, the Data Controller may become aware of any other personal data included in the message or in the fields to be completed in case of purchase.

Technical Cookie

Technical and session cookies are used, i.e. small text files containing a certain amount of information exchanged between your terminal or browser and the Website, which allow the proper functioning and enjoyment of the Website. No use is made, however, of cookies for the transmission of information of a personal nature, nor are persistent cookies of any kind used.

Analytical Cookie

Analytical cookies made and made available by third parties, namely Google Analytics, are used. This is done for mere internal statistical analysis of access, to improve the Website and simplify its use, as well as to monitor its proper functioning. However, the Data Controller has adopted the most suitable tools to reduce the identifying power of this kind of cookies as much as possible. It should be noted – for example – that the IP address anonymization function has been activated for this Website. Google Analytics publishes its cookie policy on the following page.

The Website exclusively uses profiling cookies installed by third parties.

In addition, this Web Site uses profiling cookies installed by third parties, specifically Facebook. 3. PURPOSE OF PROCESSING AND LEGAL BASIS

The personal data that the Data Controller comes into possession of are exclusively those provided by you when browsing the Website and during the use of its services. This data will be processed exclusively to:

  1. enable you to use our Web Site and its services, including the ability to access your personal area and purchase the Gift Card and/or desired tickets or, where possible, obtain the requested refund and improve your claim in case of difficulty. Some special data (such as data relating to your health status) may be processed to enable us to ascertain the existence of the indispensable requirements for you to be able to take advantage of the access services to the sports event “Internazionali BNL d’Italia” provided for the disabled. The legal basis on which this processing is based is (i) your express consent to the processing, (ii) the performance of a contract to which you are a party and (iii) the fulfilment by FITP of legal obligations;
  2. To enable us to keep you up-to-date with FITP’s activities and promotions, by sending – whether through traditional or automated contact systems, such as, for example, through the use of your e-mail address – advertising material and/or communications and information of a commercial and direct marketing nature about our services and products, related offers, discounts and any other promotional and loyalty initiatives adopted by us, as well as to enable us to send you our newsletter aimed at enabling you to benefit from the possibility of purchasing tickets on a pre-emptive basis over other users. The legal basis for this processing is your express consent to the processing.

Your personal data may be processed through both computer tools and paper media.

4. PERSONAL DATA PERIOD RETENTION

The Data Controller intends to retain your personal data for no longer than is necessary to achieve the purposes for which it was collected and processed.

Therefore, personal navigation data and personal data acquired through the use of the Web Site will not be retained for more than seven days.

With regard to personal data processed to enable you to carry out the purchase of Gift Cards and/or tickets or, where possible, to obtain the requested reimbursement, in compliance with applicable regulatory provisions, including accounting, the Data Controller will retain your personal data for a period not exceeding 10 years. Thereafter, we will provide for their deletion, or their permanent and non-reversible transformation into anonymous form.

Regarding the special data processed to enable you to take advantage of the access services to the sporting event “Internazionali BNL d’Italia” provided in favor of the disabled, in compliance with current regulatory provisions, including accounting, the FITP will retain your personal data for a period not exceeding 10 years. Thereafter, we will provide for their deletion, or their permanent and non-reversible transformation into anonymous form.

Regarding the processing activities of your personal data for the purposes of direct marketing, in compliance with regulatory requirements and provided that they have been explicitly authorized by you, FITP has determined to process your data until the revocation of your previously given consent.

With regard to all other personal data, since we cannot determine precisely their retention period, the Data Controller undertakes as of now to inspire the processing to the principles of adequacy, relevance and minimization of data, as required by the Regulations, checking annually the necessity of their retention. Therefore, once the purposes for which they were collected and processed have been achieved, we will remove them from our systems and records and/or take appropriate measures to anonymize them so that you cannot be identified.

This, except where we need to retain such data to fulfill regulatory obligations, or to establish, exercise or defend a right of ours in court.

5. CATEGORIES OF DATA RECIPIENTS

The processed data will not be disclosed to third parties. They may, however, become aware of your data, in relation to the processing purposes previously set out:

  • subjects who can access the data by virtue of legal provisions provided for by the law of the European Union or that of the member state to which the Data Controller is subject;
  • subjects that carry out, within the borders of the European Union, in total autonomy, as separate Data Controllers, or as Data Processors appointed for this purpose by FIT, purposes ancillary to the activities and services referred to in paragraph 3, i.e. postal services and shipping and home delivery agencies, companies offering advertising, marketing and communication services companies that offer IT infrastructure and IT support and consulting services as well as design and implementation of software and websites, law firms, companies that offer useful services to analyze and develop data (including those related to users’ interactions with our services) and process and conduct market research, service centers, companies or consultants appointed to provide further services to the Data Controller, within the limits of the purposes for which they were collected.

In addition, your personal data may also come to the attention of our employees, provided that they are previously designated as individuals acting under the authority of the Data Controller in accordance with Article 29 of the Regulations or as System Administrators.

Any disclosure of your personal data will take place in full compliance with the legal provisions set forth in the Personal Data Protection Regulation and the technical and organizational measures prepared by the Data Controller to ensure an adequate level of security.

6. TRANSFER OF PERSONAL DATA TO THIRD COUNTRIES

The Data Controller intends to transfer your personal data to the United States for the provision of services on the Website. Such transfer is subject to adequate safeguards under Chapter V of the GDPR. For more information on data transfer rules to countries outside the European Union, including the mechanisms on which we rely, please see the European Commission website or the Privacy Shield website.

7. ANY AUTOMATED DECISION-MAKING PROCESSES

The Data Controller does not intend to use automated decision-making processes, including profiling as referred to in Article 22(1) and (4) of the Regulations.

8. NATURE OF THE PROVISION

The provision of your personal data for the purposes referred to in paragraph 3.1 is mandatory, as your refusal to provide the personal data requested would make it impossible for FITP to allow you to use the Website, including the possibility of purchasing the Gift Card as well as tickets valid to attend the “Internazionali BNL d’Italia” sports event. However, the provision of your particular data is optional, but failure to provide it, while not preventing in any way the use of the Website, would not allow us to allow you to take advantage of the access services to the sporting event “Internazionali BNL d’Italia” provided in favor of the disabled, if requested by you.

The provision of your personal data for the purposes referred to in paragraph 3.2 is optional, but failure to provide it, while not preventing in any way the use of the Web Site, may not allow us to make you take full advantage of the benefits we offer to our community through information of an advertising, commercial and direct marketing nature, to make you receive our newsletter, as well as to inform you about additional services, events and promotions that we aim to offer you.

9. RIGHTS OF THE DATA SUBJECT

In relation to the processing of your personal data, in accordance with the Regulations, you as a data subject have the right to: i) withdraw your consent to the processing at any time. It should be emphasized, however, that revocation of consent does not affect the lawfulness of the processing based on the consent given prior to revocation; ii) request from the Data Controller access to your personal data; iii) obtain the rectification and integration of personal data deemed inaccurate; iv) obtain the deletion of your personal data; v) obtain the restriction of the processing of your personal data; vi) receive personal data concerning you in a structured, commonly used and machine-readable format, as well as have the right to transmit such data to another data controller without hindrance; vii) object at any time, on grounds relating to your particular situation, to the processing of your personal data carried out pursuant to Art. 6(1)(e) or (f), including profiling; viii) not to be subjected to decisions based solely on automated processing, including profiling; ix) to lodge a complaint with a supervisory authority or bring an action before the appropriate judicial instances, if you believe that the processing concerning you violates the Regulation.
In order to exercise each of your rights, you may contact the Data Controller, in the person of the legal representative, by addressing a communication to the registered office of (00135) Rome, Stadio Olimpico – Curva Nord, Ingresso 44, Scala G, or by sending an email to privacy@fitp.it or a p.e.c. to dpo@pec.federtennis.it, providing us with the following data:

  • first name, last name and mailing address;
  • details of the request;
  • type of admission ticket held (indicating the date, session and seat, if any, indicated on the admission ticket itself).

10. CONSENT OF MINORS IN RELATION TO INFORMATION SOCIETY SERVICES

Minors under fourteen (14) years of age are explicitly prohibited from using the services provided through the Website [with the exception of the Gift Card purchase service, tickets and, where possible, the refund request service, to use which you must be at least eighteen (18) years of age]. By signing up for the newsletter, you confirm that you have reached the age of 14. By purchasing Gift Cards, tickets or by making a refund request, where possible, you confirm that you have reached the age of 18.
